Chapter 7 Bankruptcy

Most Amarillo area bankruptcy clients opt for Chapter 7 bankruptcy. Chapter 7 bankruptcy is the most common and most familiar form of bankruptcy for most people. A Chapter 7 bankruptcy is the classic “fresh start,” allowing the client to discharge most or all of their burdensome debts. In Chapter 7 it is also possible to re-affirm certain debts, such as your car loan, in order to maximize your ability to continue your life after bankruptcy.

Credit card debts, medical bills, and other consumer debts are the most commonly discharged in Chapter 7 bankruptcy. A typical Chapter 7 bankruptcy takes between 120 and 180 days. You could be debt free in as little as four months!

Your ability to file for Chapter 7 bankruptcy is governed by a complicated code which has been amended in recent years to limit those who may file. As your bankruptcy attorney Biggs PLLC will help you navigate the federal “means test” to determine whether you are eligible to file for a Chapter 7 fresh start. For those who do not qualify for Chapter 7 relief, we offer services related to Chapter 13 bankruptcy which has many of the same benefits.

Once you receive your Chapter 7 fresh start the bankruptcy filing will appear on your credit report for seven to ten years.  The reporting of the bankruptcy on your credit report can temporarily lower your credit score.  However, getting a Chapter 7 fresh start ultimately helps your credit score in the long run.
